1. Introduction

These Terms and Conditions ("Terms") govern your use of our behavioral analysis services, including assessments, therapy, and consultations. By accessing or using our services, you agree to these Terms. If you do not agree, please refrain from using our services.
2. Services Provided
Our agency provides Applied Behavior Analysis (ABA) therapy, behavioral assessments, parent training, and related services. Services may be delivered in person, via telehealth, or through other approved means.
3. Compliance with Healthcare Regulations
We comply with all relevant healthcare regulations, including the Health Insurance Portability and Accountability Act (HIPAA), to ensure the confidentiality, integrity, and security of protected health information (PHI). Our services also comply with state and federal laws governing behavioral healthcare services.
4. Client Responsibilities
Clients and their guardians must:
Provide accurate and complete information about their medical and behavioral history.
Adhere to scheduled appointments and notify us in advance of cancellations.
Follow treatment recommendations and participate in therapy sessions as agreed.
Maintain confidentiality regarding any group sessions or shared therapy activities.
5. Confidentiality and HIPAA Compliance
We are committed to protecting your PHI under HIPAA regulations. We will not disclose your information without written consent, except as required by law or in cases of emergency. Clients have the right to request access to their records and request amendments to inaccuracies.
6. Payment and Billing
Payment for services must be made according to the agreed-upon schedule.
We accept various payment methods, including insurance, private pay, and government-funded programs.
Clients are responsible for copayments, deductibles, and any non-covered services.
Failure to make timely payments may result in service suspension.
7. Telehealth Services
Telehealth sessions require a secure internet connection and an appropriate device.
By using telehealth, clients acknowledge the inherent risks of electronic communication.
Sessions may be recorded for quality assurance, but only with client consent.
8. Cancellation and Termination Policy
Clients must provide at least 24 hours' notice for cancellations.
Repeated cancellations or no-shows may result in service termination.
We reserve the right to discontinue services due to non-compliance or safety concerns.
9. Limitation of Liability
While we strive to provide high-quality behavioral services, we are not liable for any indirect, incidental, or consequential damages arising from service use. Our liability is limited to the amount paid for services rendered.
10. Dispute Resolution
Any disputes arising from these Terms shall first be resolved through mediation. If mediation fails, disputes will be resolved through arbitration in accordance with Florida state laws.
11. Changes to Terms
We may update these Terms from time to time. Any changes will be communicated through our website or directly to clients as applicable.
